Parking Rules and Policies (12/2016)

The Parking Committee shall supervise and enforce all rules and regulations concerning parking of motor vehicles on the properties.

  • Parking is reserved for residents of the Riverwood Community and their guests. All other vehicles are subject to being towed from the premises at the vehicle owner’s expense.
  • Each resident is responsible for allowing maximum ease of pedestrian and vehicular ingress and egress over walks, streets, and driveways by prohibiting automobile parking in front of garages or in driveways and allowing no obstruction or barrier on, across or adjacent to sidewalks which would interfere with any Member’s use of the Common Areas or access to his/her own unit.
  • No parking is allowed overnight in the homeowner’s driveway by anyone. Night is defined as the hours between 11PM and 6AM.
  • No recreational vehicles, boats or motorcycles may be parked on the premises other than for a limited time to load or unload. They may be parked in a garage with the door closed.
  • Each of the driveways, 10 through 70, has a minimum of four spaces to a maximum of twelve spaces designated for guest parking that are to be used for guests only and are restricted to operative, street-legal vehicles. An exception is that guest parking spaces may be used by a resident who is in transition, such as moving in or out, but not to exceed fourteen (14) days. Resident parking in guest areas is also permitted on a short-term basis (3-4 hours) as needed during the day.
  • A guest is considered to be anyone who is not a permanent Riverwood resident. “Guest” status is lost with any substantial stay within a 30-day period in any 6-month period. That period need not be continuous. The Board of Directors shall have the final say to determine Guest status. Also, regular or continuous frequent parking in guest parking may result in the loss of guest status and could result in the towing of the vehicle.
  • Extended guest parking for more than two (2) weeks must be approved by the Parking Committee. Permits for guest parking (from 1 day to 2 weeks) may be obtained from designated parking committee members or from the parking committee chair.
  • If all guest spaces are occupied, the alternative is to park on the street, or Riverwood sometimes has rental garages available for vehicles or goods storage.
  • The Board may cause removal of any inoperative or any unsightly vehicles and any other equipment or item improperly stored in parking spaces, at the expense of the Owner, with the proviso that said removal shall take place only in compliance with the laws of the State of Oregon, County of Multnomah, and the City of Portland.
  • Failure to abide by these rules and regulations may result in the vehicle(s) being towed at the owner’s expense. Owner will be notified in writing 72 hours in advance of the towing. If a second offense occurs with the same vehicle(s), no further notice will be given and the vehicle(s) will be towed at the vehicle owner’s expense.
  • In case of hardship, upon application in writing, the Board of Directors shall consider modification or suspension of the rules for that specific case.
  • All residents are required to register their vehicle license number and information with the parking chair and must update the information if they change or acquire another vehicle.
  • Permanent resident parking permits will be issued to each Riverwood household (limit of 2) and should be displayed on the dashboard when the resident is parking in guest parking. These are not for guest use. Permanent resident parking permits should be returned to the parking committee when a resident moves.

ENFORCEMENT AND FINE SCHEDULE

Please refer to RHA’s overall Enforcement Fine Schedule for information about parking fines and other related enforcement items.

  1. Damage to Association common property: fine shall equal cost of repair/or replacement.
  2. Construction, alteration or modification of any building (including painting) without prior Architectural Committee/Board approval: fine is $100 which renews monthly, plus the cost of restoration to be the responsibility of the homeowner.  The fine will continue until corrective action is taken.
  3. Impermissible or unauthorized sign placement or display: $50 per occurrence  .
  4. Raising, breeding or keeping animals, livestock or poultry other than dogs, cats, or other household pets: $100 per occurrence.
  5. Raising, breeding or keeping dogs, cats, or other household pets for a commercial purpose: $100 per occurrence.
  6. Permitting any noxious, offensive or unsightly conditions on any part of property: $50 per occurrence.
  7. Doing anything on the property that is or may become an annoyance or nuisance to the neighborhood: $50 per occurrence.
  8. Failure to leash pets or clean up animal waste: $25 per occurrence.
  9. Using a trailer, camper-truck, tent, garage, barn, shack, or other out-building as a temporary or permanent residence on the property: $75 which renews weekly.
  10. Impermissible parking of boats, trailers, motorcycles, trucks, truck-campers, and like equipment, or junk cars or other unsightly vehicles on any street or driveway or Lot within the Association: $75 which renews weekly.
  11. Towing vehicles parked in violation of the RHA Declaration, By-laws, or Rules and Regulations: the expense incurred by the Association will be charged to owner.
  12. Unauthorized removal, alteration, or addition of any plant, tree, landscaping, or improvement in any Common Area or recreation area:  $75 per incident and/or actual cost of repair or replacement.
  13. Failure to observe Pool Rules and Regulations may result in a fine of $25 to the homeowner or host per event. Continued violations may result in the suspension or loss of pool privileges for up to 12 months.
  14. Other violations of the RHA CC&R’s, By-laws, Rules or Regulations not covered in the above may be fined $25 renewing weekly.
  15. Renting a unit without prior permission from the Board of Directors: $500 per month, renewing monthly, to be paid by the owner of the unit.
  16. Failure of the landlord to provide the Riverwood Homeowners Association with the names and contact information of renters as well as a copy of a written receipt verifying that the landlord has provided the renter with a copy of the CC&R’s, By-laws and Amendments: $50 per month until this requirement is satisfied.

LETTER FROM THE RHA BOARD TO RESIDENTS (4/2021)

The new Towing Resolution was created by the HOA’s attorney. It provides guidelines for fines and towing of vehicles in violation of the HOA’s governing documents. It also protects an Owner’s right to be heard before this Resolution is enforced.

The Fine Schedule has been updated with the following new information: “Parking in violation of RHA Declaration, By-laws or Rules and Regulations: a fine of $100 which renews weekly. Maximum fines shall be $200; after two weeks, vehicle will be towed.”

Finally, the new Parking Permit. Some Residents use it; some don’t. We would like to make all Residents aware of our Parking Policies (printed on the back of the Permit):

  • There is no Resident driveway parking.
    • One exception to this policy is for short periods when loading or unloading.
  • There is no overnight parking (11 PM to 6 AM) in Guest parking lots.
    • One exception to this policy is when you have overnight Guests (1 day to 2 weeks). Follow the instructions on the Permit and place it on the vehicle’s dashboard. Including the dates of the visit may keep the Resident from being fined or the vehicle from being towed. (See Parking Policy for details.)
    • You must have permission from the Parking Committee or Board for overnight stays longer than 2 weeks.
  • Use the new Parking Permit whenever a Resident or Guest parks in Guest parking spaces overnight.

The Board of Directors has added a Towing Resolution (above), updated the Fine Schedule (above), and added a new Parking Permit (above). These were all felt necessary due to parking violations and some confusion over which pass to use and when.
